Elderly Pneumonia Malpractice

An inflammatory condition or an infection of the lung is termed as Pneumonia. The common signs and symptoms include a varying severity and combination of a productive or a dry cough, pain in the chest, fever, and difficulty in breathing, depending on the cause.

For Elders, the classification of pneumonia is according to the types of germs that cause it and where you got the infection.

Hospital-acquired pneumonia

During a hospital stay for another illness, some people can catch pneumonia. It can be a serious case for hospital-acquired pneumonia because the bacteria causing it may be more resistant to antibiotics. There is also a possibility that the people who get it is already sick. Those people who are at high risk of this type of pneumonia are those who use on breathing machines (ventilators) and is often used in intensive care units.

Healthcare-acquired pneumonia

A bacterial infection that transpires in people who live in long-term care facilities or who receive care in outpatient clinics for this type of pneumonia. This can be caused by bacteria that are more resistant to antibiotics for the healthcare-acquired pneumonia type.

Community-acquired pneumonia The most common type of pneumonia is Community-acquired pneumonia. This type of pneumonia transpires outside of hospitals or other healthcare facilities. It may be caused by bacteria, bacteria-like organisms, fungi, and viruses.

Pneumonia Misdiagnosis

It can result in long-term disability or death once misdiagnosis delays treatment.  There have been reports of an alarming number of diagnostic errors among patients with common problems despite the serious potential consequences of misdiagnosis and pneumonia is one of these commonly misdiagnosed disorders.

According to some studies, when there is a diagnosis of pneumonia, doctors often fail to use diagnostic standards and criteria when readmitting patients after a period in the hospital for the same illness. As an outrun, needless antibiotic use, growth risk of obtaining different infection in the hospital, and additional charges.

In the latter years, it may occur for elders to find out if they were experiencing the following:

  • exacerbation of heart failure
  • a blood clot or
  • lung cancer

Elders may have recourse for injuries as a result if they were misdiagnosed with pneumonia. Elders may have been hospitalized unnecessarily, placing elders at risk of an iatrogenic injury or infection. The hospital bills, morbidity, and even mortality are the damages included. If elders you know were injured by misdiagnosis, then they might have been the victim of medical negligence or malpractice. There are a number of Law practitioners that specializes in medical malpractice that will handle this case.

Funny Laws

Most of the laws we have in this country are common sense. Do not murder. Do not steal. This sounds like the Ten Commandments. But of course, we have books and books of laws, in addition to those two stone tablets. Pay your taxes or you’ll risk going to jail. Do not litter, or you’ll pay a fine. Do not sell drugs. Do not speed while driving or your license might get suspended or, worse, revoked. These are some of the main laws people think of when they think about the law. But did you know that are silly laws too? There are! And most of them can be found online.

I’m not sure why they are laws. Maybe politicians wanted to see if the laws could pass. Maybe they were trying to make some type of joke they thought would be funny. Let’s take a look at some of these laws now.

To start, I’ll write that, in Florida, all doors in public buildings must open outwards. But what does it mean if you’re on the other side of the door? It doesn’t make sense! Maybe the politician didn’t think this one through. Perhaps they meant it to be some type of safety issue, such as, in an emergency, it would be easy for people to get out of the building. Alright, we’ll let this one pass. There are better examples, such as Roofers Wellington.

In Texas, it is illegal to sell one’s eye. Talk about trampling our rights! Also in Texas, it is illegal to milk another person’s cow. This is interesting. What if your neighbor goes on vacation? How will their cow be milked? There are plenty of more examples of silly laws we have in this country. Simply do a search on the Internet to read more. You might be surprised with some!

The Tax Law is Signed

Today, President Donald Trump signed the tax law. We will feel the effects in February 2018. He has been talking about it for a long time. Finally, it’s been solidified. Almost everybody is going to save money on taxes. That being said, there is some controversy regarding this law. After all, there is controversy on all major new laws.

Most people will save between a few hundred to a few thousand dollars each year. By most people, I mean individuals or families making less than one hundred thousand dollars a year. The real controversy comes from two main things. Business is going to save a whole lot more. And the business tax cuts are permanent, while individual tax rates will eventually go up in about ten years. First, let’s talk about the business savings.

A business will save either millions or billions of dollar. So, what do they get to keep that much money when families only get to keep a few thousand? The answer isn’t in a dollar amount. The answer is in the percentage of taxes paid. For example, individuals and families will save about 2% of taxes each year. But business will save much more than that. The reason for this is that Congress and the president want businesses to create jobs with their extra money. Will they do this? Only time will tell.

The goal is for more people to get hired, for the economy to grow faster, and for more people to get more raises and bonuses. The great news is that some people will get bonuses. Companies like AT&T and Comcast have announced bonuses to all of their employees. That’s wonderful! I hope they continue to do things like that. And I hope that they give raises as well. Who knows, you or I might also be beneficiaries of these raises!

Foreign Laws

Different countries and different laws. It would behoove the world travel to brush up on these before visiting any other country on vacation. Actually, people should learn basic laws even if they are visiting other countries for work, or any other reason. It’s one thing to spend a night in jail in America. It’s another thing to spend a night in jail in Tadmor, Syria! Most people should not be visiting Syria anyway since they are still reeling from their civil war.

American cities are not always clean. I’m talking about the large cities, mostly. Chicago, New York, and Los Angeles come to mind. The word “litterbug” comes to mind. A litterbug is someone to throws garbage on the ground, instead of putting it in a trash can. I like to think the majority of Americans do not litter. There are plenty of videos online showing people littering. Some people even throw trash from their vehicles while driving. Where is the respect? Littering in the US comes with fines. Some places have higher fines than others. However, do not litter in Singapore.

Littering in this Asian country will cost $1,000 plus community service. That is extremely expensive for throwing some garbage on the ground. I don’t think there are too many litterbugs in Singapore. Even if there were a lot, they would be easily spotted. Here’s a fun fact: after three littering offenses, the litterbug has to wear a sign on their attire saying that they littered. So, they will be broke, have to work for free, and face public humiliation. That’s not fun! But I suppose that’s what it takes. I’m sure Singapore is one of the cleanest countries in the world.

The takeaway is careful where you are going. What may seem like a small offense in America might be a big offense elsewhere. Don’t let what you may think is not important land you in a foreign jail!

The 2017 Tax Bill

If one were to turn on the television to watch the news they would see headlines talking about a tax cut. The proposed law is officially called the 2017 Tax Cuts and Jobs Act.

Like all major proposed bills, there is bound to be some controversy. Democrats say that the bill is a tax cut for the rich and will hurt the poor. They are strongly against it. However, they are outnumbered in Congress. Republicans say that the bill is a tax cut for the working middle class and all taxpayers. Who is right? It may be possible there is some truth to both sides, actually.

On the Democrat side, they also say that private schooling would be state tax deductible. They argue that the rich already have enough money to send their kids to private school. Therefore, for that reason, they shouldn’t get a tax cut.

On the Republican side, they argue that cutting taxes for all taxpayers will generate an economic boom which will help everyone. They are also planning on increasing the child tax credit. This is probably something that all sides can agree is a great thing.

The bill has already passed both the House of Representative and the Senate. However, each bill is a little bit different. Now that both bills have passed, in essence, committees will have to come together and iron out any differences. Then, if approved by both sides, the bill would be sent to the president’s desk for final signing into law. President Trump will sign it because he has been among the most vocal supporters of the law.

The bill is scheduled to be signed into law before Christmas. That being said, no matter what side one is one, we can all hope that the law will stimulate our economy for the better.

No Laws

What would happen if there were no laws? Look no further than movies like The Purge (2013).

The plot of The Purge is fairly straightforward. People are given 12 hours to do whatever they want. Nothing is illegal! No laws for 12 hours! The only law during this time is that everything is legal. Why would the government allow this?

Fast forward to a dystopian-type future. Prisons are overpopulated, crime is rampant, and law enforcement is stretched thin. Speaking of thin, perhaps the government wants to thin-out the masses. What better way would there be for the population to just “sort it out” themselves?

The result of this, as one might imagine, is grave. It doesn’t end well! Looting, murder, and maybe worse happens during this 12-hour period. Surely, parts of the population will be thinned out. Gangs will go to war and there will be many casualties. Unfortunately, this 12-hour free-for-all has consequences. Many innocent people will also be victims.

How should a person prepare for The Purge? Perhaps more importantly, how does a family prepare for this 12 hours of mayhem? The answer would be to lock up, take cover, and stay awake.

An alarm system would be worthless during these 12 hours. If there is a home break-in no police will show up. After all, crime is not answered during The Purge! The only way to answer crime is to arm up and take care of it, personally.

So, that is essentially what life would be life with no laws. There are anarchists in many countries to advocate the end of government. No one should have an interest in that! If that were to happen, The Purge would surely soon follow.
